Understanding the New California Digital Goods Disclosure Law
Effective Date: Wednesday, January 1, 2025
Applies To: All digital course material purchases made through Royalty Achieved and its affiliates.
To comply with California Assembly Bill No. 2426 (AB-2426), titled Consumer Protection: False Advertising: Digital Goods, Royalty Achieved is committed to ensuring that all consumers receive full and accurate disclosure of the terms under which digital products are offered and licensed. This notice sets forth the licensing practices, access conditions, and download parameters associated with digital goods purchased from Royalty Achieved.
This disclosure applies to all digital content available through Royalty Achieved and any affiliated platforms, resellers, or institutional partners. By purchasing or redeeming access to digital course material through our platform, you are agreeing to the license terms detailed below.
Licensing Disclosure
All digital products available on the Royalty Achieved platform are licensed, not sold. This means your purchase grants you limited, personal, non-exclusive, non-transferable rights to access and use the digital content in accordance with the applicable license terms.
License Duration
Each digital product includes a clearly defined access period, which is disclosed on the product description page at the time of purchase:
-Fixed-Term License: This license provides access to the content for a defined time (e.g., 30 days, 90 days, 180 days, 1 year).
-“Lifetime” License: Unless otherwise specified, a “Lifetime” license refers to five (5) years of online access through the Royalty Achieved platform, along with the right to permanently download the product to a supported device.
Royalty Achieved may update or refine the definition of "Lifetime" as technology evolves, but any change will be disclosed prior to purchase.
License Characteristics
-Non-Transferability: All licenses are strictly non-transferable. The license is assigned exclusively to the purchasing individual’s account and cannot be sold, assigned, lent, or otherwise shared with any other person or entity.
-Content Ownership: You do not acquire ownership of the digital product or its intellectual property. The rights to the underlying content remain with the publisher, author, or original copyright holder.
-Access Scope: The license grants specific access and usage rights, which may include online reading, note-taking, highlighting, and other interactive features depending on the product type and platform capabilities.
Lifetime Licenses
When a product is labeled with a “Lifetime” license, the following applies:
-Online Access: You will retain access to the product through your Royalty Achieved account for a period of five (5) years from the date of purchase or code redemption.
-Download Rights: You are permitted to download the product to one supported device for permanent offline access.
-Technical Support & Maintenance: Downloaded files are supported only on compatible devices and platforms that Royalty Achieved supports at the time of download. Royalty Achieved does not guarantee future compatibility if the device or software becomes obsolete.
License Activation and Redemption Process
Once you purchase a digital product, or if a product is purchased on your behalf (e.g., through an institution), the license is activated upon:
-Direct purchase through your Royalty Achieved account, or
-Redemption of an access code through your Royalty Achieved profile.
The system then associates your account with a digital license that governs your use, access duration, and device compatibility.
Downloads
Most digital products allow for permanent downloads to supported devices. Download terms include:
-Device Support: Downloads are compatible with the two most recent versions of major operating systems (e.g., Windows, macOS, iOS, Android).
-Functionality: Downloaded content will remain accessible as long as the platform, file format, and operating system are supported by Royalty Achieved.
-Loss of Support: If your device or software environment becomes outdated or incompatible due to system updates or end-of-support status, the downloaded file may no longer function correctly.
Royalty Achieved does not assume responsibility for the continued operability of downloaded content on unsupported platforms or systems.
